Combined DoJ Glossaries of Legal Terms
Copyright Policy
Your accessing and using the Combined DoJ Glossaries of Legal Terms (Combined Glossaries) is taken as your agreement to be legally bound by the terms of this Copyright Policy. The terms may be modified and/or supplemented from time to time by the Government of the Hong Kong Special Administrative Region (Government) without prior notice. Please check the Combined Glossaries website regularly for any modification and/or supplement which may be made.
Copyright in the Combined Glossaries
Except for copyright belonging to third parties, the Government owns the copyright in the text of the Combined Glossaries, the typographical arrangement of glossary entries published on the Combined Glossaries and the systematic and methodical arrangement of the glossary data on the Combined Glossaries in accordance with the Copyright Ordinance (Cap. 528).
Permission to Reproduce the Combined Glossaries
| 1. |
Subject to paragraphs 2 to 5 below, you may download, print, disseminate, distribute and make copies of the glossary entries published on the Combined Glossaries.

| 2. |
You must ensure that copies made of any glossary entry are accurate.
|
| 3. |
The permission granted under paragraph 1 above does not apply to any third party rights in respect of which the Government has no authority to grant permission.
|
| 4. |
The Government may withdraw the permission at any time without giving any reason or prior notice.
|
| 5. |
If you wish to mass replicate glossary entries from the Combined Glossaries (e.g. by downloading or copying a large volume of glossary entries from the Combined Glossaries by program or by other means (whether in batches or in one go) for any purpose, e.g. development, training and enhancement of Artificial Intelligence (AI) models) (referred to as Mass Replication);
or reproduce the glossary entries published on the Combined Glossaries in a product (e.g. a book, journal, publication, content generated by computer programs including AI models, software or database) (Product) for subscription or distribution (referred to as Product Reproduction), please refer to the Terms and Conditions for Mass Replication or Product Reproduction below.

Terms and Conditions for Mass Replication or Product Reproduction
Your Mass Replication or Product Reproduction from the Combined Glossaries is taken as your agreement to be legally bound by these terms and conditions as may be modified and/or supplemented from time to time by the Government without prior notice. Please check the Combined Glossaries website regularly for any modification and/or supplement which may be made.
The Government grants a revocable, non-exclusive, royalty-free, non-transferable and non-sub-licensable licence to you for Mass Replication or Product Reproduction, subject to the terms and conditions set out below. Such licence does not apply to any third party rights in respect of which the Government has no authority to grant a licence.
General Terms and Conditions
| 1. |
Except for copyright belonging to third parties, the Government owns the copyright in the text of the Combined Glossaries, the typographical arrangement of the glossary entries published on the Combined Glossaries and the systematic and methodical arrangement of the glossary data on the Combined Glossaries in accordance with the Copyright Ordinance (Cap. 528).

| 2. |
The Government has the right to determine in its sole discretion whether or not there is Mass Replication or Product Reproduction of the glossary entries from the Combined Glossaries.
|
| 3. |
You must indemnify and keep indemnified the Government from and against all demands, claims, actions, proceedings, liabilities, losses, damages, costs and expenses arising in any manner from or in relation to—
| (a) |
your action or omission in relation to the Mass Replication or Product Reproduction; or |
| (b) |
any breach by you of any provision of this licence. |
This paragraph survives the termination of this licence for any reason and continues in full force and effect despite such termination.

| 4. |
If you fail to comply with any of these terms and conditions, this licence ends automatically.
|
| 5. |
You have no right to any compensation as a result of the termination of this licence for any reason.
|
| 6. |
These terms and conditions are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region and the parties submit to the jurisdiction of the courts of the Hong Kong Special Administrative Region.

Terms and Conditions for Mass Replication
| 7. |
You may, at your own expense, make such necessary and appropriate technical arrangements for accessing the data repository of the Combined Glossaries and replicating the data in the repository. The Government is not under any obligation to facilitate any such arrangement.
|
| 8. |
However, if such arrangement may affect the operation of the Combined Glossaries, the Government has the right to terminate such replication without prior notice.
|
| 9. |
You must comply with all regulations, conditions or restrictions laid down from time to time by any laws, telecommunication service provider or regulatory authority in relation to the transmission, use or storage of, or access to or dealing with, the glossary entries published on the Combined Glossaries.
|
Terms and Conditions for Product Reproduction
| 10. |
You must ensure that the reproduction of any glossary entries published on the Combined Glossaries (Reproduced Entries) included or displayed in the Product is accurate. The Reproduced Entries must not be reproduced, made available or used in a misleading or derogatory manner.

| 11. |
You must include or display in the Product a statement in a manner satisfactory to the Government indicating the following—
| (a) |
except for copyright belonging to third parties, the Government owns the copyright in all contents in the Combined Glossaries, including the text of the Combined Glossaries, the typographical arrangement of glossary entries published on the Combined Glossaries and the systematic and methodical arrangement of the glossary data on the Combined Glossaries; |
| (b) |
Reproduced Entries included or displayed in the Product are replicated or reproduced from the Combined Glossaries under a licence granted by the Government, and such licence does not apply to any third party rights in respect of which the Government has no authority to grant a licence; |
| (c) |
the Government is not responsible for the accuracy or updatedness of the Reproduced Entries included or displayed in the Product; and |
| (d) |
the Combined Glossaries is available free of charge on the Combined Glossaries website as maintained by the Department of Justice of the Government at https://www.glossary.doj.gov.hk, and users may visit the Combined Glossaries website to access the Combined Glossaries. |

| 12. |
You may refer to the Reproduced Entries in the course of advertising, marketing or promoting the availability of the Reproduced Entries in the Product in a manner satisfactory to the Government. But you must not state or imply in any manner that the Product is approved or endorsed by the Government. You must comply with any notice issued by the Government requesting you to discontinue such reference or modify the manner in which the Reproduced Entries are so referred to.

| 13. |
You must use your best endeavours to protect the Government’s copyright in the Reproduced Entries included or displayed in the Product. Without limiting the foregoing, you must promptly notify the Government of any suspected infringement of the Government’s copyright in the Reproduced Entries included or displayed in the Product that comes to your notice. Such notification should be addressed to the Government via e-mail at glossary_enquiry@doj.gov.hk. You must also—
| (a) |
indemnify and keep indemnified the Government from and against all demands, claims, actions, proceedings, liabilities, losses, damages, costs and expenses arising in any manner from or in relation to any such suspected infringement; and |
| (b) |
at the Government’s direction and at your own expense, initiate negotiations and assume the conduct of proceedings in relation to any such suspected infringement. |
Subparagraph (a) above survives the termination of this licence for any reason and continues in full force and effect despite such termination.

凡政府無權限就任何第三方的權利給予許可,以上第1段給予的許可,不適用於該項第三方的權利。

如你希望從《律政司法律詞彙合併版》大量複製詞條(例如為任何目的(如為開發、訓練和提升人工智能(AI)模型 )而使用程式或其他方法(不論分批或一次過)從《律政司法律詞彙合併版》下載或複製大量詞條)(稱為大量複製)或在產品(如書籍報刊、刊物、電腦程式(包括AI模型、軟件或資料庫)所生成的內容)(產品)中轉載於《律政司法律詞彙合併版》刊載的詞條,以供訂閱或分發(稱為產品轉載),請參閱下列「大量複製或產品轉載的條款及條件」。

凡從《律政司法律詞彙合併版》進行大量複製或產品轉載,即視為同意在法律上受本條款及條件所約束,而本條款及條件可不時由政府在不給予事先通知下,予以修改及/或補充。請定期瀏覽《律政司法律詞彙合併版》網站,以查閱修改及/或補充條款及條件。
政府給予你一項可撤銷、非專屬、免版稅、不可轉讓及不可轉授的特許,以進行大量複製或產品轉載,但須受下列條款及條件所約束。凡政府無權限就任何第三方的權利給予特許,本特許不適用於該項第三方的權利。
一般條款及條件

除第三者擁有的版權外,政府按照《版權條例》(第528章),擁有以下三者的版權:《律政司法律詞彙合併版》的文本、於《律政司法律詞彙合併版》刊載的詞條的排印編排,及以具系統性及特定的方式就《律政司法律詞彙合併版》中的詞彙資料作出的編排。

| 2. |
政府有絕對酌情權,判定某行為是否屬從《律政司法律詞彙合併版》大量複製詞條,或就詞條進行產品轉載。
|
| 3. |
你須就源於或關於以下事項而(不論以何形式)引致的索求、申索、法律行動、法律程序、法律責任、損失、損害、費用及開支,向政府作出彌償,並須保持令政府獲得彌償 ——
| (a) |
你關於大量複製或產品轉載的行動或不作為;或 |
| (b) |
你違反本特許的任何條文。 |
不論本特許基於任何理由而終止,本段的效力不受影響。即使本特許已終止,本段繼續具有十足效力及作用。

| 4. |
如你違反本條款及條件的任何段落,本特許即自動終止。
|
| 5. |
你無權因本特許終止(不論基於任何理由)而獲得任何補償。
|
| 6. |
本條款及條件受香港特別行政區法律所規管,並按照香港特別行政區法律詮釋。各方均同意受香港特別行政區法院的司法管轄權所管轄。
|
從《律政司法律詞彙合併版》大量複製詞條的條款及條件
| 7. |
你可作出必須而合適的技術安排,以接達《律政司法律詞彙合併版》的資料儲存庫,以及複製其中的資料,但你須自行承擔相關開支。政府並無義務就上述安排提供便利。

| 8. |
然而,如上述安排可能影響《律政司法律詞彙合併版》的運作,則政府有權在不給予事先通知下,終止該等複製。
|
| 9. |
你須遵從任何法律、電訊服務商或規管機構不時訂定的關於傳送、使用、儲存、取覽或處理於《律政司法律詞彙合併版》中刊載的詞條的所有規例、條件或限制。
|
在產品中轉載詞條以供訂閱或分發的條款及條件
| 10. |
你須確保產品所收載或展示的、於《律政司法律詞彙合併版》中刊載的轉載詞條(轉載詞條)內容準確。不得以誤導或貶損的方式轉載、提供或使用轉載詞條。

| 11. |
你須以令政府滿意的方式,在產品中包含或展示一項說明以下事項的陳述 ——
| (a) |
除第三者擁有的版權外,政府擁有以下三者的版權:《律政司法律詞彙合併版》的文本、於《律政司法律詞彙合併版》內刊載的詞條的排印編排,及以具系統性及特定的方式就《律政司法律詞彙合併版》內的詞彙資料作出的編排; |
| (b) |
產品所收載或展示的轉載詞條,是根據政府給予的特許(上述特許),從《律政司法律詞彙合併版》複製或轉載的,凡政府無權限就任何第三方的權利給予特許,上述特許即不適用於該項第三方的權利; |
| (c) |
產品所收載或展示的轉載詞條是否準確或及時更新,政府概不負責; |
| (d) |
用戶可直接於政府律政司管理及更新的《律政司法律詞彙合併版》網站(網址:https://glossary.doj.gov.hk),免費閱覽《律政司法律詞彙合併版》。 |

| 12. |
你可用令政府滿意的方式,在宣傳、推銷或推廣含轉載詞條的產品的過程中,提述轉載詞條,但不得以任何方式述明或暗示,產品獲政府核准或認可。如政府發出通知,要求你終止上述提述或修改提述轉載詞條的方式,你即須遵從。

| 13. |
你須盡最大努力,保障產品所收載或展示的轉載詞條的政府版權。在不局限前句的原則下,你如知道有人涉嫌侵犯產品所收載或展示的轉載詞條的政府版權,則須將此事從速通知政府。你須將有關通知,透過電郵glossary_enquiry@doj.gov.hk傳送予政府。你亦須 ——
| (a) |
就源於或關於任何涉嫌侵權行為而(不論以何形式)引致的索求、申索、法律行動、法律程序、法律責任、損失、損害、費用及開支,向政府作出彌償,並須保持令政府獲得彌償;及 |
| (b) |
依照政府的指示,就該等涉嫌侵權行為,展開洽商和進行法律程序,並須自行承擔相關開支。 |

| 7. |
你可作出必须而合适的技术安排,以接达《律政司法律词汇合并版》的数据储存库,以及复制其中的数据,但你须自行承担相关开支。政府并无义务就上述安排提供便利。

你须确保产品所收载或展示的、于《律政司法律词汇合并版》中刊载的转载词条(转载词条)内容准确。不得以误导或贬损的方式转载、提供或使用转载词条。

你须以令政府满意的方式,在产品中包含或展示一项说明以下事项的陈述 ——
| (a) |
除第三者拥有的版权外,政府拥有以下三者的版权:《律政司法律词汇合并版》的文本、于《律政司法律词汇合并版》内刊载的词条的排印编排,及以具系统性及特定的方式就《律政司法律词汇合并版》内的词汇数据作出的编排; |

| 12. |
你可用令政府满意的方式,在宣传、推销或推广含转载词条的产品的过程中,提述转载词条,但不得以任何方式述明或暗示,产品获政府核准或认可。如政府发出通知,要求你终止上述提述或修改提述转载词条的方式,你即须遵从。
